    • The Client is required to complete and sign a Liability Waiver prior to participating in any sessions at the Facility.

    • Client agrees to abide by the club dress code at all times while in the Facility. Body By Benson has no responsibility or liability for the safekeeping or theft of personal belongings.

    • Client voluntarily participates in classes and acknowledges the risks associated with using the Facility, including the risk of injury or death. Client assumes all risks related to the use of the Facility and its equipment. In consideration of using the Facility, Client agrees to release, discharge, and waive any and all claims against Body By Benson, its owners, agents, employees, and representatives for any damages, injuries, or death resulting from participation in fitness programs, exercise classes, or use of equipment. Client represents that they are in good health and do not suffer from any condition that would prevent them from safely participating in activities. Client either has approval from a physician or assumes all risks associated with participation.

    • Amidst the current developments surrounding communicable diseases, Client affirms that they are healthy and do not present an increased risk due to COVID-19 or other infectious diseases. Body By Benson has no responsibility or liability if Client contracts COVID-19.

  • The Client is required to always wear grip socks during all scheduled sessions. If the Client arrives to his or her session without grip socks, the Client must either purchase grip socks from Body By Benson or cancel the scheduled session (late cancel fees apply).

    • Any cancellation of a group session by a Client within twelve (12) hours of said session shall result in a Ten ($10.00) Dollar late fee charged to Client in addition to Body By Benson’s ‘no-refund’ policy.

    • Any cancellation of a private or semi-private training session by a Client within twenty-four (24) hours of said session shall result in a Ten ($10.00) Dollar late fee charged to Client in addition to Body By Benson’s ‘no-refund’ policy.

    • Failure to attend a group session, a semi-private training session, or a private training session shall result in a Twenty ($20.00) Dollar ‘no show’ fee charged to Client in addition to Body By Benson’s ‘no-refund’ policy.

    • If a client cancels before the late cancel window, the credit will return to their account to use before its expiration date.

    • There are no refunds for sessions canceled outside of the cancellation window—only account credit will be provided.

  • Body By Benson does not offer refunds for any reason to Client. This ‘no-refund’ policy includes, but is not limited to, sessions, services, packages, and merchandise.

    Sessions are non-transferable.

    • Clients are required to purchase a session in order to join the waitlist for a class.

    • If a spot becomes available, clients will be automatically added to the class and notified at least 12 hours prior to the start of class through the notifications they have opted into on their Mindbody account (email and/or text notifications).

    • Please only sign up for the waitlist if you intend to attend the class if a spot opens.

    • If a client remains on the waitlist and does not get added to the class roster, the class credit will return to their account and can be used before its expiration date.

    • There are no refunds for classes you are waitlisted for.

    • The Client shall arrive five (5) minutes prior the scheduled start time of any session. If the Client arrives early, he or she may remain quietly in the waiting area until the studio is prepared.

    • If the Client arrives late, he or she will not be admitted into the scheduled session, without exception.

    • In the event the Client arrives late, and the Client is admitted to participate in the scheduled session, the session shall end at the originally scheduled time.

    • Purchasing a session for a group class must be completed through Mindbody prior to the start of the class; the Client’s ability to book a group class shall cease five (5) minutes before the session begins. Once purchased, a Client is restricted from sharing a session with another Client, or transferring said purchased session with another Client, or any other person who is not a Client, for any reason.

    • Purchasing a session for private and semi-private training sessions is by appointment only and must be completed through Mindbody; the Client shall schedule the appointment at least twenty-four (24) hours ahead of time and is subject to availability of the Body By Benson staff. Once purchased, a Client is restricted from sharing a session with another Client, or transferring said purchased session with another Client, or any other person who is not a Client, for any reason.

    • All sessions must be paid for in advance by Client to reserve a spot on the schedule including reserving a spot on the waitlist.
